YourStaffGY — a recruitment service operated by Talent Force Solutions, Guyana
These Terms govern access to and use of the YourStaffGY platform and the recruitment, placement, verification, coordination and related services provided under the YourStaffGY brand. By creating an account, publishing a profile or vacancy, purchasing or requesting a service, or otherwise using YourStaffGY, you agree to these Terms.
Effective date:to be confirmed
1. About YourStaffGY
YourStaffGY is a recruitment and workforce placement service operated by Talent Force Solutions in Guyana. For purposes of these Terms, "YourStaffGY", "we", "us" and "our" refer to Talent Force Solutions operating under the YourStaffGY brand.
YourStaffGY connects employers seeking workers with individuals seeking employment, and may provide recruitment-related services including: candidate sourcing; access to candidate contact information; candidate availability confirmation; interview coordination; candidate screening and pre-interviews; credential and identity verification; employment reference verification; candidate placement assistance; recruitment outside the existing YourStaffGY candidate directory; and administrative assistance with work permit and immigration processes where separately contracted.
Registration and publication of a basic candidate profile or employer account are free unless otherwise stated on the Platform.
Additional recruitment, verification, placement, promotional and administrative services may be subject to fees.
"Candidate" means an individual registered with or recruited through YourStaffGY for potential employment. "Employer" or "Client Employer" means a person, company, organization or other entity using YourStaffGY to identify, evaluate, interview, recruit or hire workers. "Platform" means the YourStaffGY website and any associated digital services.
2. Nature of the recruitment service and the employment relationship
Who the employer is, and who is responsible for what
YourStaffGY acts as a recruitment and placement intermediary between Candidates and third-party Employers.
Unless expressly established otherwise in a separate written agreement, YourStaffGY is not the employer of Candidates recruited, referred or placed through the Platform.
Where an Employer decides to hire a Candidate, the employment relationship is established directly between the Employer and the Candidate.
The Employer is responsible for determining and agreeing with the Candidate on all terms and conditions of employment, including, as applicable:
- job title and duties;
- salary or wages;
- working hours;
- probation;
- leave;
- benefits;
- workplace rules;
- supervision;
- National Insurance Scheme (NIS) obligations;
- taxes and statutory deductions;
- occupational health and safety;
- termination; and
- all other obligations arising from the employment relationship.
YourStaffGY may source, screen, interview, verify, coordinate and recommend Candidates. However, unless expressly agreed otherwise in writing, the final hiring decision remains with the Employer.
A Candidate profile, shortlist, interview, recommendation, verification report or other communication from YourStaffGY does not constitute an employment contract or a guarantee of employment.
3. Legal and regulatory compliance
YourStaffGY shall conduct its recruitment activities subject to the laws and regulatory requirements applicable in the Co-operative Republic of Guyana.
Where registration, licensing, authorization or other regulatory approval is required for a particular recruitment or related service, that service shall be provided subject to the applicable legal requirements.
Employers and Candidates must use YourStaffGY only for lawful employment and recruitment purposes.
Nothing in these Terms authorizes an Employer, Candidate or YourStaffGY representative to circumvent any requirement imposed by employment, immigration, tax, National Insurance, occupational safety, data protection or other applicable law.
4. Equal opportunity and non-discrimination
YourStaffGY is committed to fair and lawful recruitment practices.
YourStaffGY shall not discriminate in the provision of recruitment services or in facilitating employment on any ground prohibited by the Prevention of Discrimination Act, Cap. 99:08, or other applicable law, subject to any exception or genuine occupational qualification permitted by law.
Employers may specify legitimate requirements relating to qualifications, experience, skills, licences, language proficiency, availability and other characteristics genuinely relevant to the performance of a particular position.
Employers must not request, instruct or encourage YourStaffGY to exclude, prioritize or otherwise discriminate against Candidates on any ground prohibited by applicable law.
YourStaffGY reserves the right to refuse, remove or suspend any vacancy, recruitment request or Employer account that we reasonably believe is discriminatory, unlawful, fraudulent, exploitative or inconsistent with these Terms.
5. Candidate registration and information
Candidates may create a profile and participate in the basic YourStaffGY candidate directory without paying a recruitment fee.
Candidates are responsible for ensuring that information provided to YourStaffGY is accurate, current and not misleading. Candidates must not provide:
- false employment history;
- false qualifications;
- forged or altered identification;
- fraudulent licences or certificates;
- false references; or
- materially misleading information concerning their qualifications, immigration status, employment history or identity.
YourStaffGY may suspend or remove a profile where there is reasonable evidence that information or documentation supplied by the Candidate is false, fraudulent or materially misleading.
Removal from the Platform does not prevent YourStaffGY from retaining information where retention is reasonably necessary for legal, regulatory, fraud-prevention, accounting or dispute-resolution purposes, subject to applicable law.
6. What YourStaffGY verifies
Read this clause before buying any verification
Where an Employer purchases a verification service, YourStaffGY will take reasonable steps, within the scope of the service purchased, to assess the authenticity and consistency of information presented by the Candidate. Depending on the service, this may include:
- confirming identity;
- reviewing identification documents;
- reviewing educational qualifications;
- comparing qualifications with information reasonably available from relevant institutions or other sources;
- contacting references;
- confirming previous employment where reasonably possible;
- interviewing the Candidate; and
- cross-checking information provided through different sources.
Verification is performed on a reasonable-efforts basis.
The ability to verify information may depend on the availability and responsiveness of educational institutions, former employers, referees, public records and other third parties.
A statement that a credential or reference has been verified means that YourStaffGY completed the applicable verification procedure and found the information reasonably consistent with the evidence obtained. It does not constitute an independent certification by YourStaffGY.
7. What YourStaffGY does not guarantee
Unless expressly included in a separately purchased assessment service, YourStaffGY does not certify or guarantee:
- practical skills;
- technical competence;
- future job performance;
- personal conduct;
- reliability;
- workplace compatibility;
- productivity; or
- suitability for a particular Employer or workplace.
The Employer remains responsible for determining whether a Candidate is appropriate for the position.
Technical interviews, trade tests, professional examinations, practical assessments and other job-specific evaluations remain the responsibility of the Employer unless YourStaffGY has expressly agreed in writing to arrange or provide them.
A verification report is intended to assist the Employer's decision-making process. It does not replace the Employer's own interview, assessment or due diligence.
8. Level 1 — Unlock
Level 1 provides an Employer with access to the contact information that a Candidate has authorized YourStaffGY to make available through the recruitment service. This may include the Candidate's telephone number, email address and other authorized contact information.
Level 1 does NOT include contact by YourStaffGY with the Candidate to confirm current availability or interest.
It does not guarantee that the Candidate remains available, will respond, is interested in the Employer's particular vacancy, will attend an interview, will accept an offer, or will perform satisfactorily if hired.
The Employer contacts the Candidate directly. The applicable Level 1 fee is charged when the contact information is revealed.
Once Candidate contact information has been disclosed, the Level 1 service is considered delivered and is non-refundable, except where otherwise required by applicable law.
Access already granted to contact information does not expire merely because the Employer does not immediately contact the Candidate.
9. Level 2 — Availability and interview coordination
Under Level 2, YourStaffGY provides active recruitment coordination. Our staff will contact the Candidate, confirm the Candidate's current availability, confirm interest in the employment opportunity, and coordinate an interview between the Candidate and Employer.
The Employer must provide sufficient information concerning the vacancy and proposed interview arrangements.
Payment
The Level 2 fee is payable 100% in advance before YourStaffGY begins the service.
Each Candidate interview constitutes a separate appointment for billing purposes unless a different arrangement is expressly stated. A single Employer request may contain multiple Candidate appointments.
Candidate no-show
If a Candidate fails to attend a confirmed interview, the Employer may choose either a full refund of the Level 2 fee paid for that Candidate, or a replacement Candidate, to be provided by YourStaffGY within 72 hours of confirmation that the Candidate failed to attend the scheduled interview.
No additional Level 2 service fee will be charged for the replacement Candidate.
Completion of the service
Once the Candidate attends the confirmed interview, the Level 2 service in relation to that Candidate is considered fully performed and completed, regardless of the outcome of the interview.
This includes situations where the Employer decides not to hire the Candidate; the Candidate is not considered suitable for the position; the Candidate decides not to accept the position or continue with the recruitment process; or the Employer and Candidate do not reach an agreement concerning employment.
The Level 2 fee is non-refundable once the Candidate has attended the confirmed interview, except where otherwise required by applicable law.
Employer cancellation or no-show
If the Employer cancels or fails to attend a confirmed interview, the cancellation and refund provisions set out in Section 18 shall apply.
Go to Section 18 — Refunds and cancellations
Where attendance is disputed, YourStaffGY may contact both parties and review available records to determine whether the Candidate and Employer attended the scheduled interview.
A report of non-attendance by either party does not automatically determine the outcome. YourStaffGY may reasonably verify the circumstances before issuing any applicable refund or arranging a replacement Candidate.
10. Level 3 — Verification and placement support
Level 3 is YourStaffGY's enhanced recruitment and verification service. Depending on the Employer's requirements, it may include:
- extended Candidate sourcing;
- searches within and outside the YourStaffGY directory;
- Candidate pre-interview;
- identity verification;
- credential verification;
- employment reference checks;
- preliminary suitability screening;
- interview coordination; and
- placement support.
Payment
The Level 3 Verification service has a total fee of GYD 30,000 per Candidate, payable in two instalments.
- First payment — GYD 15,000: payable in advance to begin the Candidate verification process.
- Second payment — GYD 15,000: payable upon completion of the verification process and delivery of the Verification Report.
The Verification Report will describe the verification steps undertaken by YourStaffGY, the information that could be confirmed, any information that could not be independently verified, and any relevant limitations encountered during the process.
The first payment is non-refundable once YourStaffGY has begun the verification process, as it compensates YourStaffGY for the work performed in investigating and verifying the Candidate's information.
The second payment becomes due upon delivery of the Verification Report, regardless of whether all elements submitted by the Candidate could be independently verified. YourStaffGY's obligation is to perform the agreed verification process with reasonable diligence and to report accurately what could and could not be verified.
Payment for Level 3 does not depend on whether the Employer subsequently interviews, hires or rejects the Candidate, nor on the Candidate's subsequent employment performance.
11. Candidates sourced outside the Platform
A Level 2 or Level 3 search may extend beyond Candidates already registered with YourStaffGY.
Where YourStaffGY identifies a potential Candidate outside the Platform, the individual may be invited to register and provide the necessary consent before being formally included in the recruitment process.
YourStaffGY will not intentionally create a public Candidate profile using personal information obtained from an individual who has not agreed to participate in the service.
12. Employer responsibilities
Employers using YourStaffGY must provide accurate information concerning vacancies, including material information about:
- position and duties;
- location;
- required qualifications;
- working arrangements;
- compensation where required or represented;
- legal eligibility requirements; and
- any other condition reasonably relevant to a Candidate's decision to pursue the position.
Employers must not:
- publish fraudulent or misleading vacancies;
- use Candidate information for purposes unrelated to legitimate recruitment;
- resell Candidate information;
- publish Candidate contact information;
- provide Candidate information to unauthorized third parties;
- charge Candidates a fee for being considered for a vacancy through YourStaffGY where such fee is unlawful or represented as a YourStaffGY fee;
- harass Candidates; or
- use the Platform for unlawful, discriminatory, deceptive or exploitative purposes.
The Employer remains responsible for complying with all legal obligations arising once it hires a Candidate.
13. Candidate data, privacy and consent
Data Protection Act 2023
YourStaffGY processes Candidate and Employer personal information for recruitment, placement, verification, administration, security and related legitimate business purposes in accordance with applicable data protection law, including the Data Protection Act 2023.
Personal data shall be processed lawfully, fairly and transparently and collected for specified, explicit and legitimate purposes.
Candidates shall be informed of the purposes for which their personal information is collected, used, stored and disclosed.
Where consent is relied upon as the legal basis for processing, YourStaffGY shall obtain consent that is freely given, specific, informed and unambiguous, through a clear affirmative action.
Where appropriate, separate consent may be requested for specific processing activities, including the disclosure of Candidate contact information or other Candidate information to prospective Employers.
Candidate information may be used, where appropriate and lawfully authorized, to:
- create and maintain a Candidate profile;
- identify potential employment opportunities;
- match Candidates with Employer requirements;
- communicate with Candidates;
- verify identity and credentials;
- contact references and previous employers;
- coordinate interviews;
- communicate relevant Candidate information to prospective Employers; and
- administer recruitment and placement services.
Creating a Candidate profile does not, by itself, mean that every document or item of personal information submitted by the Candidate becomes visible to Employers.
Identification documents and other sensitive documentation shall not be publicly displayed merely because they were submitted to YourStaffGY.
YourStaffGY maintains a separate Privacy Policy explaining in greater detail how personal information is collected, used, stored, disclosed, retained and protected, as well as the rights available to individuals under applicable data protection law.
Candidates and Employers shall be provided with access to the Privacy Policy when registering for or using services involving the processing of personal information. Where these Terms and the Privacy Policy address the same data-processing activity, they shall be read together.
14. Disclosure of Candidate information to Employers
Candidate contact information is not publicly displayed in the general directory.
Candidate contact information or other personal information shall be disclosed to an Employer only where such disclosure is permitted under the applicable YourStaffGY service and is consistent with the Candidate's authorization and applicable data protection law.
Where Candidate consent is relied upon for disclosure, YourStaffGY shall obtain the appropriate consent before the relevant information is disclosed.
An Employer receiving Candidate information may use it only for legitimate recruitment and employment purposes connected with the relevant vacancy or recruitment activity.
The Employer must not sell, publish, distribute, commercially exploit or disclose Candidate information to an unauthorized third party.
Once Candidate information has been lawfully disclosed to an Employer, the Employer is responsible for its own subsequent collection, use, storage, disclosure and protection of that information in accordance with applicable law.
15. Interviews and disclosure of Employer identity
Where YourStaffGY coordinates an interview, the Candidate may be provided with information reasonably necessary to attend and evaluate the opportunity, including:
- Employer identity;
- interview location or online meeting information;
- date and time;
- position being discussed; and
- relevant contact or attendance instructions.
YourStaffGY may withhold certain Employer identifying information during preliminary recruitment stages where appropriate, but information necessary for an informed Candidate decision will be disclosed when reasonably required.
Interviews may be conducted in person or online, according to the arrangements agreed for the vacancy.
16. Internal recruitment notes
Internal recruitment, screening, administrative and case-management notes created by YourStaffGY personnel are internal business records and are not part of the recruitment product delivered to the Employer or Candidate unless disclosure is required by applicable law.
This does not affect any person's rights of access to personal information granted under applicable data protection law.
17. Payments and platform balance
Where YourStaffGY does not provide automated card payment processing, payments may be made using the payment methods communicated by YourStaffGY.
An Employer may maintain a credited balance on the Platform.
Where a payment is reported or a payment receipt is uploaded, the payment is not considered confirmed until YourStaffGY verifies receipt of the funds.
If an Employer does not have sufficient credited funds, YourStaffGY may issue an invoice. Unless otherwise agreed, work requiring advance payment does not begin until the required payment has been confirmed.
Coupons, promotional credits or service credits may be limited to a particular Employer; may be limited to a particular service; are not transferable unless expressly authorized; and have no cash value unless otherwise required by law.
The price presented to the Employer before confirmation will be the applicable price for that transaction.
A service already paid for will not be retrospectively increased because YourStaffGY subsequently changes its prices.
18. Refunds and cancellations
Refunds and cancellations are subject to the following conditions and to any rights that cannot be excluded under applicable law.
General cancellation policy
If an Employer cancels a paid service before YourStaffGY has begun providing that service, the Employer is entitled to a refund of 50% of the amount paid.
The remaining 50% is retained to cover administrative, processing and service-reservation costs associated with the cancelled service.
Once YourStaffGY has begun providing the service, the service will be considered commenced and no refund will be available, except where a specific refund or replacement right is expressly provided below.
For purposes of this section, a service is considered to have begun when YourStaffGY has commenced the substantive activity included in the service purchased, such as releasing Candidate information, contacting or coordinating with a Candidate, or beginning a Candidate verification process.
Level 1 — Unlock
Level 1 is considered fully delivered once the Candidate's contact information has been disclosed to the Employer.
Once the information has been disclosed, no refund is available, regardless of whether the Employer subsequently contacts, interviews or hires the Candidate.
If the Employer cancels before the Candidate's contact information has been disclosed, the General Cancellation Policy applies and 50% of the amount paid will be refunded.
Level 2 — Availability and interview coordination
If the Employer cancels a confirmed interview at least 24 hours before the scheduled interview time, the Employer is entitled to a refund of 50% of the Level 2 fee paid for that Candidate.
If the Employer cancels the interview less than 24 hours before the scheduled interview time, or fails to attend the confirmed interview, no refund will be available.
Once the Candidate attends the confirmed interview, the Level 2 service is considered fully performed and no refund is available, regardless of the outcome of the interview.
If the Candidate fails to attend the confirmed interview, the Employer retains the rights established under Section 9 and may choose either a full refund of the Level 2 fee paid for that Candidate, or a replacement Candidate within 72 hours.
Level 3 — Verification
The first Level 3 payment of GYD 15,000 authorizes YourStaffGY to begin the Candidate verification process.
If the Employer cancels the Level 3 service before YourStaffGY has begun the verification process, the Employer is entitled to a refund of 50% of the first payment, equivalent to GYD 7,500.
Once YourStaffGY has begun the Candidate verification process, the first payment is considered earned for services commenced and is non-refundable, regardless of how much information can ultimately be independently verified.
The second payment of GYD 15,000 is payable upon completion of the verification process and delivery of the Verification Report. Because the second payment becomes due against delivery of the completed Verification Report, the second payment is non-refundable once the report has been delivered.
Refund method
Approved refunds will be processed using the refund method established by YourStaffGY and communicated to the Employer.
Any processing time required by a bank, payment provider or financial institution after YourStaffGY issues the refund is outside YourStaffGY's control.
Nothing in this Refund and Cancellation Policy excludes or limits any right that cannot lawfully be excluded under the laws of Guyana.
19. Service delivery times
YourStaffGY may provide estimated or committed delivery periods for particular services. Unless another period is displayed or agreed:
- Level 2 services are normally targeted for completion within 3 business days; and
- Level 3 services are normally targeted for completion within 10 business days.
Where payment is required before work begins, the applicable service period begins when payment is confirmed.
Delivery periods may be affected by circumstances outside YourStaffGY's reasonable control, including delays by Candidates, Employers, referees, educational institutions, previous employers or government authorities.
Where YourStaffGY expressly commits to a delivery date and fails to provide the contracted service by that date for reasons attributable to YourStaffGY, the Employer may request an appropriate refund or credit for the undelivered portion.
20. Work permits and immigration services
Where separately contracted, YourStaffGY may provide administrative assistance and coordination relating to work permit or immigration processes connected with recruitment. Depending on the service purchased and applicable legal requirements, this may include:
- organizing documentation;
- coordinating with the Employer;
- coordinating with an appropriate immigration agent or other authorized person;
- preparing administrative portions of an application where legally permitted;
- assisting with submission procedures; and
- tracking administrative progress.
Immigration services are separate from the standard recruitment levels unless expressly included in the purchased service.
YourStaffGY does not guarantee approval of any work permit, visa, extension, immigration status or other governmental authorization.
Approval or refusal remains exclusively within the authority of the Government of Guyana or other competent governmental authority.
Payment for immigration assistance purchases the administrative service, not a governmental decision. No YourStaffGY employee, contractor or representative is authorized to promise approval or guarantee a governmental processing or decision date.
A governmental refusal does not, by itself, establish that YourStaffGY failed to perform the contracted administrative service.
YourStaffGY does not provide legal advice unless the advice is provided separately by a person legally authorized to do so.
Uploading a document to the YourStaffGY Platform does not itself constitute submission of that document to the Government of Guyana.
22. No Candidate recruitment fee
Creating a standard Candidate profile and being considered for employment opportunities through the ordinary YourStaffGY recruitment process does not require payment of a recruitment or placement fee by the Candidate.
Optional services purchased voluntarily by a Candidate, such as Premium promotional visibility, are separate from recruitment eligibility and do not improve the Candidate's substantive evaluation.
No person is authorized to guarantee a job in exchange for payment on behalf of YourStaffGY.
Candidates should report any person claiming to represent YourStaffGY who requests unauthorized payment in exchange for guaranteed employment.
23. Reports, misconduct and account sanctions
Users may report suspected fraud; false profiles; fraudulent vacancies; harassment; discrimination; requests for unauthorized payments; misuse of personal information; or other violations of these Terms.
YourStaffGY may investigate reports and may request information from the parties involved. Depending on the circumstances, YourStaffGY may issue a warning; remove content; temporarily suspend an account; remove a vacancy; restrict access to particular services; or permanently block an account.
A report does not automatically establish wrongdoing.
YourStaffGY may take reasonable interim measures while investigating serious allegations where necessary to protect Candidates, Employers, the Platform or other users.
24. Fraud and misrepresentation
Candidates and Employers must not knowingly provide false, forged, altered or materially misleading information to YourStaffGY.
YourStaffGY reserves the right to terminate or suspend services where fraud or material misrepresentation is reasonably suspected.
Where appropriate and permitted by law, suspected criminal conduct or fraudulent documentation may be reported to the relevant authorities.
25. Third-party information
Some recruitment and verification activities depend on information supplied by third parties, including Candidates; Employers; referees; previous employers; educational institutions; professional organizations; and government authorities.
YourStaffGY will take reasonable steps appropriate to the purchased service but cannot guarantee the accuracy, completeness or availability of information controlled by independent third parties.
26. Limitation of liability
To the fullest extent permitted by applicable law, YourStaffGY and Talent Force Solutions will not be responsible for losses arising solely from:
- an Employer's independent hiring decision;
- a Candidate's subsequent workplace performance or conduct;
- an Employer's subsequent conduct toward a Candidate;
- workplace conditions controlled by the Employer;
- information deliberately concealed or falsified by a Candidate or Employer and not reasonably detectable through the contracted service;
- decisions of government authorities;
- failures or delays by independent third parties; or
- events outside YourStaffGY's reasonable control.
YourStaffGY remains responsible for performing the services actually contracted with reasonable care and in accordance with applicable law.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
27. No employment guarantee
Registration with YourStaffGY does not create a right to employment.
YourStaffGY does not guarantee that a Candidate will receive an interview; an Employer will make an offer; a Candidate will accept an offer; employment will continue for any particular period; or an Employer will successfully fill every vacancy.
Recruitment inherently depends on the decisions and circumstances of independent Candidates and Employers.
28. Platform availability
YourStaffGY may update, maintain, modify or temporarily suspend parts of the Platform. We do not guarantee uninterrupted availability of every Platform function at all times.
Where temporary technical unavailability affects a paid service, YourStaffGY will take reasonable steps to restore access or otherwise provide the contracted service.
29. Changes to services and prices
YourStaffGY may modify its services, features and prices. Changes to prices or service conditions apply prospectively.
A paid service already confirmed will retain the material price and service conditions applicable when the transaction was accepted unless the Employer and YourStaffGY agree otherwise or a change is required by law.
30. Changes to these Terms
YourStaffGY may update these Terms from time to time. The effective date displayed at the beginning of the Terms identifies the current version.
Material changes affecting future purchases or use of the service will be communicated through the Platform or another reasonable method.
Changes will not retrospectively remove contractual rights attached to a service already paid for unless required by applicable law.
Continued use of the Platform after updated Terms take effect constitutes acceptance of those Terms where legally permitted.
31. Termination of accounts
A Candidate or Employer may stop using YourStaffGY subject to any outstanding contractual or payment obligations.
YourStaffGY may suspend or terminate an account for material violation of these Terms; fraud; repeated misuse of Candidate information; harassment; unlawful discrimination; fraudulent job postings; unauthorized requests for money; abuse of Platform systems; or other serious unlawful or harmful conduct.
Termination does not extinguish payment obligations already incurred or rights and obligations that by their nature should survive termination.
32. Severability
If any provision of these Terms is found by a competent authority to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the extent necessary to make it enforceable where legally possible. The remaining provisions will continue in effect.
33. No waiver
Failure by YourStaffGY to enforce a provision of these Terms on one occasion does not constitute a permanent waiver of that provision or of our right to enforce it later.
34. Entire agreement
These Terms, together with the applicable service order, invoice, Privacy Policy and any other terms expressly incorporated into a transaction, constitute the agreement governing the relevant YourStaffGY service.
Where YourStaffGY and an Employer enter into a separate written Recruitment Services Agreement, the terms of that agreement will prevail over these general Terms to the extent of any direct inconsistency concerning the services covered by that agreement.
35. Electronic acceptance
Where the Platform requires a user to select "I Agree", "Accept", or an equivalent electronic confirmation, that affirmative action constitutes the user's acceptance of these Terms to the extent permitted by applicable law.
Where required, consent relating specifically to the processing or disclosure of personal information shall be obtained separately from general acceptance of these Terms.
The Platform may maintain electronic records showing the identity or account associated with the acceptance; the version of the Terms accepted; the date and time of acceptance; and the affirmative action by which acceptance was provided.
Such electronic records may be retained for contractual, legal, regulatory, security and dispute-resolution purposes in accordance with applicable law and the YourStaffGY Privacy Policy.
36. Governing law and jurisdiction
These Terms and the services provided by YourStaffGY are governed by the laws of the Co-operative Republic of Guyana.
Any dispute arising from these Terms, the Platform or services provided by YourStaffGY shall be subject to the jurisdiction of the competent courts of Guyana, unless the parties have entered into a separate written agreement providing for another lawful dispute-resolution mechanism.
37. Contact and support
Questions concerning recruitment services; Candidate profiles; Employer accounts; payments; invoices; service delivery; refunds; privacy; or these Terms should be submitted through the official YourStaffGY support channels identified on the Platform.
Users should not rely on statements concerning prices, guarantees, employment, immigration approval or refunds made by persons who are not authorized representatives of YourStaffGY.
Important notice to Candidates
YourStaffGY does not sell jobs.
Creating a standard Candidate profile and participating in the ordinary recruitment process are free for Candidates.
Payment for an optional promotional service such as Premium does not guarantee employment or preferential selection.
The final decision to hire belongs to the Employer.
Important notice to Employers
YourStaffGY assists Employers in identifying, screening, verifying and recruiting Candidates.
Our verification and recruitment services reduce uncertainty but do not transfer the Employer's responsibility for making the final hiring decision or complying with its obligations as an employer.
Employers should conduct any technical or professional assessment appropriate to the position before making a final employment decision.
